The following General Purchase Conditions and Usage will regulate all offers and transactions on the website www.nisimoda.com. They will also regulate access to and use of the website itself.

- Purchase Order
All purchase general conditions can be modified anytime, without any further notice. Additional modifications/new conditions will be valid since the moment they will be published in the website section called " Conditions". All users are therefore invited to take a look at the general conditions before placing an order and to keep a copy of it according to law regulation art. 50 and following of D. Lgs 206/05. Applicable general purchase conditions will be those that are valid at the date of customer's purchase. By placing an order, customers will automatically agree with and accept them.
- Contract conclusion
In accordance with Administrative Italian Reagulation form of 9th of April 2003, n 70 reagarding new disposal in terms of electronic commerce, Patrizia Nisi inform all customers that: - The client can buy any kind of product, with relevant info for each product, in the electronic catalogue on www.nisimoda.com - Contract will be considered closed after the order has been registered into database and after a general check regarding the purchase order and correct payment details. - After that a confirmation email will be sent automatically to the customer regarding all information on the purchased product, price, payment methods, shipping costs or any other additional costs. - The order form will be filed in PATRIZIA NISI database as long as the order is processed and in accordance to law. - In case of no order acceptance because of unavailability of selected products or longer delivery time than agreed, clients will be informed immediately by mail or phone. In this specific case customers can change product, wait for availability according to the new delivery time or cancel the order itself and ask for refund.
- Missing acceptance, even partial, of a purchase order, will not give any right to get refunded, and it wil not be considered cause of contract/extra contract responsabilities for causing direct or indirect damage to people and/or things.
- Offers validity & prices
- All products prices are in Euros, tax included ( VAT ). Shipping costs and any other additional cost, VAT included, will be specified separetely in euros in the purchase order form before it is submitted as well as in the order confirmation mail. - Products prices can be modified without notice but the price the customer will be charged of will be the one shown in the product description in the order form.
- Products availability
All products are constantly updated in the website. However, it may happen that some time a specific article is not available for immediate shipping. In this case customers will be immediately informed by email and they can modify their purchase order, wait for availabilty according to new delivery time specified or ask for refund. If payment has already been sent the entire amount paid (product price, shipping fees, additional costs) will be transferred by PATRIZIA NISI to the same payment source used for transaction.
Patrizia Nisi publish on their website all texts and images based on high performance and precision; however, any possible technical or graphic mistake will not be under their personal responsability. Possible mistakes on the website will be immediately corrected.
Patrizia Nisi allow themselves the right to make any kind of modification and/or correction on their website, any time it is necessary, without any specific comunication.
Patrizia Nisi will be not responsible for any information published on the website which will not be in compliance with the customer's country law concerning ecommerce, as well as for any problem, damage or risk the customer may have during web serfing on their website.
- Shipping Date
All incoming orders will be processed within the next 24h, from monday to friday; any incoming order during weekends will be processed within next monday.
- Product info and online images
All products information must be considered as general informative. Images and product colours published on the website can differ from real; products description contains general colour info only. In case of any doubt customers can ask for more info. Images on the site are owned by Patrizia Nisi and all rights are reserved. Their use is forbidden without permission.
Whenever customers want to have additional info regarding shipping it is sufficient to send an email to our customer service contact. There will be a prompt reply.
- Privacy info (ex art 13 D.Lgs 196/2003 - regulation and protection of people/things and their personal data) According to this regulation all personal data will be protected in terms of privacy, accuracy and transparency. Patrizia Nisi guarantee that all customers personal data required to place an order will be digitally or manually treated according to the above regulation and that they will be used for the following purposes: - Clients relationship (Incoming order, shipping, administrative functions, internal stas, feedback, preliminary personal data for order conclusion or any specific service). - Purposes connected with Italian law regulation. - Commercial promotions and info strictly connected with Patrizia Nisi business - All data requested is mandatory, any incomplete data will cause total or partial contract resolution - All data won't be comunicated or spread to other people - According to Italian law regulation art 13. Dgs n. 196/2003 customers have the right to:
1) Ask for confirmation of own personal data possesed by Patrizia Nisi by mail. 2) Know the origin , logic, purpose of their treatment. 3) Obtain their update, integration with additional info if needed. 4) Ask for cancellation or update in anonymous form or block in case of illegal use. 5) Refuse their usage for promotions goals or any other commercial purpose or market research. In this case it is mandatory to write a communication by an official mail to firstname.lastname@example.org.

7) Suspension, modification or end of sale activity Patrizia Nisi has the right to suspend, modify or close website activity. In this case there will be no responsibility for any inconvenience caused.
Applicable Law and Area of Competence: All incoming orders are considered as a contract between customers and Patrizia Nisi and it will be regulated by the seller's country jurisdiction (Italy). Any legal dispute after contract finalization is under customer's territorial competence and refers to the customer's country jurisdiction. In all other cases it will refer to Udine jurisdiction (Italy).
Returned Good policy:
According to art. 64 & following of D.Lgs 206/05, the customer has the right to return goods or to cancel purchase order contract, without any penalty and without any additional specification, within next 14 days from incoming order, except as specified below. In order to return goods customer has to: 1) Send a mail to email@example.com within 14 days from incoming order by indicating clearly the articles codes that are to be sent back. The client will receive a confirmation mail with authorization to send back, with all specified info in order to proceed. 2) Within14 days the customer, after being authorized, can ship goods back bearing shipping expense. It is mandatory that all goods will be shipped back in their original packaging, with all accessories, without any damage or modification. Goods must be shipped to the following address within 48 hours from customer service approval:

The rights of returning goods is, however, regulated also by the following conditions: - The right of withdrawal can be applicable to the entire goods only and it cannot be considered valid or examinated for partial goods purchased. - Goods must be intact and shipped back with their original packaging complete in all parts. In order to limitate additional damage to the package we reccomend, if possible, to insert package into an additional one. It isn't possible to put any adhesive tape or labels on the original package.
Returning goods will be under customer responsibility till they arrive at our warehouse . For any damage caused during delivery Patrizia Nisi will inform customers within 5 working days about the inconvenience in order to let customer proceed for eventual third part responsibility and to be refunded if insured. In this specific case the product will remain at customer's disposal for 10 days for restitution to be planned by mail. This will be valid issue to revoke withdrawal and reimbursement rights. Patrizia Nisi will not respond for any damage or loss caused during product shipping back delivery. Whenever package will result damaged after examination Patrizia Nisi will withhold a sum to cover the costs for a new packaging.
Right to return goods will fall for the presence of any of the following conditions - Absence or label damage. - Direct damage on the article bought. - Packaging missing or damaged. - Missing products parts. - All other damage caused with the exception of transport. If applicable reimbursement will be processed within 30 days. Only delivery costs will be withhold.
Warranty and products non-conformity
In case of non-conformity of delivered products or products that differ from what stated in the order confirmation email, the customer has the right to have the product repaired or substituted without any additional cost if the product is still available in stock.
As an alternative the customer has the right to get a discount or to cancel the order.
In the former case PATRIZIA NISI will give back the amount of money previously agreed upon with the customer. In the latter case PATRIZIA NISI will refund the entire amount paid by the client at time of purchasing, including delivery and any additional costs.
The amount to be refunded will be notified and credited on the same card or e- wallet of purchasing.
Customer must notify non conformity to Patrizia Nisi, within 20 days from delivery by sending an email to firstname.lastname@example.org.
After receiving an authorization mail the customer can return the item which must be intact, protected in its original package and sealed.
It must be accompanied by all accessories and documents provided at time of purchasing. This warranty will not apply in case of items repaired, modified or altered by the customer.
Conventional warranty on sold products are those supplied directly by the vendor.
